SCOTUS TRUMPS Obstructionist Courts: Travel Ban On

The tweaks are regrettable but the President's authority to impose it is firm.

Whether or not Kennedy will go will be up in the air and we hope. I don't know medicine well enough to imagine what the progressives will do to keep Ginsberg animated.

Under the original

Under the original Constitution the President has no authority whatsoever except to inforce the laws passed by Congress. The only laws regarding immigration as set out in the Constitution are the Congress can set the requirements for naturalization of immigrants and the power to ban all immigration. The original 13 States are the determiner of who they will admit as immigrants. See Article 1 Section 9. If the Congress has passed laws in violation these provisions, they are unconstitutional and if the President has been given authority to interpret these laws with regulations he is enforcing laws that the Congress has no power to make nor to delegate their law making authority.

This argument is moot, because since 1824 the Congress and the President have been freed by the Supreme Court to do just about anything that is not specifically prohibited by the Constitution. This failure to obey the Constitution is what has created the mess we find ourselves in and it will never be changed at the ballot box because too many people have benefited from its violation.

"Under the original

"Under the original Constitution the President has no authority whatsoever except to inforce (sic) the laws passed by Congress."

I'm sure glad for the education I get here under our constitutional guru.

Up until this comment, I labored under the misconception that the President is the Chief Executive of the government apparatus, and that, specifically, he manages/leads/directs the Executive Branch of the Federal Government. Which, I used to think, meant everything except the legislative branch (Congress) and the judicial branch (SCOTUS & their offspring).

Life is just one big learning experience.

Even if what some "learn" is at the hands of false prophets.

His greatest power is to

His greatest power is to prevent the Congress from passing laws they have not been given power to under the provisions of Article 1 Section 8. Even then he can be overruled by 2/3 vote of both houses. Even then, the Supreme Court has been named arbiter of what is constitutional under the Judiciary Act of 1789 which itself is an expansion of the power given it by the Constitution itself. The Job he was elected to perform is that of Commander in Chief in time of war.

The Constitution was a compromise between competing economies; one based on barter and the other based on artificial means of exchange. As with any compromise the result neither satisfies one nor the other and their bastardization has been the result. That in the interim the Constitution has become a sterile document is exemplified by the fact we now have laws that defend animals and plants and I defy you to find anything in the original document that permitted the government to do so.

The bastardization began in 1789, before the ink was even dry on the actions of the first Congress. It has not yet ceased. My next book, now at the publisher is titled The Constitution, A Document Steeped in History and a Compromise Devoid of Promise. It explains how by ignoring the prohibitions in the original document we have morphed into a society were laws protecting animals and plants has taken precedence over protecting the lives, freedoms and property of humans.

That explains why the government considers me a turnip, and not a particularly valued one

The government considers you

The government considers you a voter and if your vote counts you will be given welfare or an opportunity to get into the social security system. If it doesn't count you will be ignored and considered a non-entity. Those who count are in the 51% and those that don't are in the 49%.
